A personality diagnosis is not a legal category: Dutch courts decide on conduct and evidence, not on whether your partner is a narcissist. What the law does offer are concrete instruments against manipulative or obstructive behaviour, such as provisional measures under Article 822 of the Dutch Code of Civil Procedure (Rv), a prejudgment attachment and an order to produce documents; the main exception to the usual advice is mediation, which generally works poorly when one party does not negotiate in good faith.
Below we explain which behaviour causes legal problems, which instruments the court has, how to build a written record, and how to keep the case about the facts. Calling the other party a narcissist in letters or court documents almost always damages the person who does it.

What can the law do, and what can it not do?
The law cannot change your partner’s personality and does not punish a character trait. It can limit the consequences of specific behaviour: it settles arrangements quickly, secures assets, forces disclosure of information and enforces agreements.
Midlertidige tiltak mens skilsmissen pågår
Under Article 822 Rv, the court can make provisional measures (forløpende fasiliteter) for the duration of the divorce proceedings. They can decide who may use the family home and order the other spouse to leave it, with whom the children live, how contact is arranged and what maintenance is paid. Under Article 821 Rv, the hearing must start no later than the third week after the week in which the request was filed.
Securing assets and information
A prejudgment attachment (konservatoriumsbeslag) secures assets before they can be moved. Under Article 700 Rv it requires leave from the preliminary relief judge (sikringsrett). Artikkelen vår om narsissisme og formuesdeling sets out the rules on concealed assets and agreements signed under pressure.
Under Article 22 Rv, the court can order a party to provide specific documents relevant to the case. Under Article 21 Rv, both parties must state the relevant facts fully and truthfully, and the court can draw the conclusions it sees fit from a breach of that duty. The court can also appoint an expert, for example to value a business.
Enforcing arrangements
Under Article 611a Rv, the court can attach a penalty payment (dwangsom) to an order, such as a contact arrangement. If an arrangement is still not observed, the court can change it. In urgent matters, summary proceedings (kort geding) under Article 254 Rv can produce a binding order within weeks.
Which behaviour causes legal problems?
Legally, what matters is behaviour with consequences, not a list of personality traits. A court can assess shifting accounts, withheld information, obstructed contact and the use of children as a means of pressure.
In practice, the following behaviour most often leads to legal problems in a divorce:
- denying agreements that were made verbally, or refusing to treat any agreement as final;
- withholding financial information or moving assets;
- sending large volumes of hostile messages to prolong the conflict;
- using the children as messengers or obstructing contact;
- involving schools, family or employers against the other partner;
- threatening to damage the other partner’s job or business.
Each of these can be documented, and each links to an instrument: agreements can be laid down in writing, information can be demanded under Article 22 Rv, contact can be enforced with a penalty payment and threats can be reported to the police.
Less obvious forms of manipulation
Manipulation is not always loud. Some people present themselves as the victim while shifting blame or making false accusations against the other parent; this covert pattern is harder to recognise, also for professionals. In court the answer is the same: a sequence of small, dated incidents carries more weight than a description of someone’s personality.
What can you do if there is violence or a threat?
Call the police. Under Article 2 of the Temporary Restraining Order Act (Vått tidsriktig husrom), the mayor can order a violent partner to leave the home for ten days; under Article 9 of that Act, the order can be extended to at most four weeks.
A civil court can also impose a contact ban or a restraining order (kontaktforbud or straatverbod) in summary proceedings, usually with a penalty payment for each breach. Within the divorce, a provisional measure under Article 822 Rv can give you exclusive use of the family home.
Why is mediation usually not the right route?
Mediation depends on both parties negotiating in good faith, and that is exactly what is missing here. If you do try it, make sure the mediator knows about the imbalance, take independent legal advice alongside it and keep the option of a court procedure open.
Under Article 815 Rv, a divorce petition must contain a parenting plan (ouderskapsplan) signed by both spouses. If agreement is impossible, the petition explains why, and the court then decides on care, contact and child maintenance.
Hvordan samler du bevis?
Keep a dated, factual record and collect the documents that support it. Under Article 150 Rv, the party that relies on a fact must in principle prove it, so your own records carry much of the weight.
Useful material includes bank statements, e-mails, text messages and other communication that shows a pattern of pressure or control. Statements from family members, teachers or professionals who saw the behaviour themselves can also help; they carry most weight when the witness describes what they saw, not what they concluded.
Record each incident with the date, the time and what exactly happened. One incident rarely carries a case; a documented sequence over several months can.
Obtain evidence lawfully. Reading the other party’s e-mail or logging in to their online banking without permission breaches their privacy, can be a criminal offence under the Dutch Criminal Code, and usually weakens your own position in court. Use the routes the law offers instead, such as an order to produce documents under Article 22 Rv.
An example to illustrate: a mother agrees by phone that the children will spend the autumn holiday with their father. A week before, he denies the agreement. Because she confirmed the call by e-mail the same evening and he did not reply, she has a written record, which together with a log of three cancelled handovers gives the court a concrete basis for a fixed holiday schedule.
How do you conduct the case in practice?
Whatever the other side’s motivation, the way you conduct the case determines much of its outcome. Five habits do most of the work.
Få alt ned i skrift
Confirm every conversation by e-mail the same day, factually and without comment, and make proposals in writing with a deadline, for example ten working days. Over a few months this produces the contrast a court notices: one party concrete and constructive, the other not.
Hold tonen flat
Write as if every message will be read aloud in court, because it may well end up in the court file. Do not respond to provocation, at length or immediately; the same applies to social media and to anything said in front of the children.
Begrens tvisten
Settle what can be settled, in writing and item by item, so that only a few concrete questions remain for the court. Under Article 237 Rv, costs between spouses are usually compensated, but the court can order a party to bear costs that it caused unnecessarily.
Use procedural instruments, not persuasion
If the other party ignores agreements, the answer is a court order with a penalty payment under Article 611a Rv, not another letter. In matters involving children, a detailed arrangement with fixed schedules, fixed handovers and one channel of communication often works better than any attempt to improve the relationship.
Manage cost, timeline and your own energy
A party who thrives on conflict benefits from open-ended proceedings. Set a budget with your lawyer, decide which points are worth contesting and review that every few months. Support from a counsellor or the people around you helps you decide on the merits instead of accepting a poor settlement just to make it stop.
Why does a diagnosis not help you in court?
Narcissistic personality disorder (NPD) is a diagnosis that only a qualified clinician can make, and as such it plays no role in a Dutch family case. A label invites a dispute about the label; the court assesses conduct, and in cases about children its primary concern is the best interests of the child.
Show the patterns instead: shifting accounts, withheld information, missed handovers, messages sent to the children. A parent who gives the child room for a relationship with the other parent is in a stronger position than a parent who draws the child into the conflict.
What should you check as the parent or spouse who wants to leave?
- Is every agreement about the children, the home and money confirmed in writing, with a date?
- Do you have copies of bank statements, pension overviews and the most recent tax returns?
- Is there a risk that assets will be moved, so that a prejudgment attachment is needed?
- Do you need provisional measures under Article 822 Rv for the home, the children or maintenance?
- Is your own correspondence something you would be comfortable having read out in court?
- If there is violence or a threat: have you reported it to the police?
What should you check if you are the one accused of manipulative behaviour?
- Which specific acts are you accused of, and what documents does the other party rely on?
- Do your own messages and e-mails support your account of what was agreed?
- Have you provided all financial information the other party and the court may ask for under Articles 21 and 22 Rv?
- Do you comply with every existing contact arrangement or court order, so that no penalty payment is forfeited?
- Does your parenting plan proposal give the children room for a relationship with the other parent?
What can we do for you in a divorce from a manipulative partner?
As familieadvokater, we focus on facts, evidence and the right instruments. In practice, we:
- review your situation and documents and set out which instruments fit, if needed in the background before your partner knows you have legal advice;
- draft and file the request for provisional measures under Article 822 Rv;
- apply for leave for a prejudgment attachment and request orders to produce financial documents;
- bring summary proceedings for a contact ban or for enforcement of a contact arrangement with a penalty payment;
- handle all correspondence with the other party, so that the written record stays factual;
- draft a detailed parenting plan with fixed schedules and handovers.
Sammendrag
- A diagnosis of narcissism has no legal effect; Dutch courts decide on conduct and evidence.
- Provisional measures under Article 822 Rv settle the home, the children and maintenance while the divorce is pending; under Article 821 Rv the hearing starts no later than the third week after the request.
- A prejudgment attachment secures assets, and the court can order documents to be produced and attach penalty payments to arrangements.
- A consistent written record and a calm tone are your strongest tools; mediation generally works poorly when one party does not act in good faith.
- In case of violence, the mayor can impose a ten-day restraining order, extendable to four weeks.
Ofte stilte spørsmål
Må jeg bevise at partneren min er narsissist?
No. The court does not assess diagnoses. You need to prove the specific acts on which your request is based, such as withheld information, concealed assets or obstructed contact; under Article 150 Rv the burden of proof lies with the party relying on those facts.
Kan jeg få juridisk rådgivning uten at partneren min vet det?
Yes. A lawyer can advise you in the background before any step is taken. Your partner will only learn of it when you take a formal step, such as filing a petition or a request for provisional measures.
Hva kan jeg gjøre hvis eksen min ikke overholder samværsavtalen?
If the arrangement was laid down by the court, you can ask the court to attach a penalty payment under Article 611a Rv or to change the arrangement. Keep a dated record of every missed contact moment.
Er mekling en god idé med en manipulerende partner?
Usually not, because mediation depends on both parties negotiating in good faith. If you choose it anyway, make sure the mediator knows about the imbalance and take independent legal advice alongside it.
